End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and VRealSoftware LLC ("Company," "we," "us," or "our") governing your use of the InSki mobile application and related services (collectively, the "App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. License Grant

Subject to your compliance with this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices owned or controlled by you, in accordance with the App Store Terms of Service (Apple) and Google Play Terms of Service (Android).

2. User-Generated Content (UGC) & Moderation

The App allows users to post content, including photos, videos, comments, and trip plans ("User Content"). You retain ownership of your content but grant us a worldwide, royalty-free license to use, display, and distribute it in connection with the App.

a. Prohibited Content

You agree NOT to post content that:

Is unlawful, harassing, abusive, threatening, or defamatory.
Contains hate speech, nudity, pornography, or graphic violence.
Promotes illegal acts or dangerous behavior that risks public safety.
Infringes on the intellectual property or privacy rights of others.

b. Content Moderation

We have a zero-tolerance policy for objectionable content and abusive users. We reserve the right to:

Monitor and review User Content.
Remove any content that violates this Agreement without prior notice.
Suspend or ban users who violate these terms.
Provide tools for users to report offensive content or block abusive users.

3. Safety & Assumption of Risk

WARNING: SKIING AND SNOWBOARDING ARE DANGEROUS ACTIVITIES.

By using the App, you acknowledge and agree that:

The App provides information (maps, conditions, tracking) for reference only and may not be accurate or real-time.
You are solely responsible for your own safety and decision-making on the mountain.
You assume all risks associated with skiing, snowboarding, and mountain travel, including injury or death.
We are not liable for any accidents, injuries, or damages resulting from your use of the App or reliance on its data.

4. Location Services

The App requires location access to provide core features such as tracking runs, locating friends, and displaying maps. Continued use of GPS running in the background can dramatically decrease battery life. You may disable location services in your device settings, but some features may not function.

5. Subscriptions & Payments

The App offers premium features through InSki+ via auto-renewing subscriptions.

Subscription Details:

Available Plans: Monthly and Annual subscriptions
Pricing: Subscription prices are displayed in the App and in the App Store
Free Trial: New users may receive a free trial period as indicated at sign-up. You will be charged when the trial ends unless you cancel beforehand
Billing: Payment will be charged to your Apple ID account at confirmation of purchase
Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period
Cancellation: You can manage and cancel subscriptions at any time in your device's Account Settings. No refunds will be provided for unused portions of a subscription term
Changes: We reserve the right to modify subscription pricing with advance notice. Price changes will not affect active subscriptions until renewal

One-Time Purchases (Tip Jar):

The App may offer the ability to make voluntary one-time contributions ("Tips") to support the development of the App.

Nature of Purchase: Tips are voluntary and do not unlock additional features or content unless explicitly stated.
Payment Processing: All tips are processed via Apple In-App Purchase and are subject to Apple's Terms and Conditions.
Refunds: Because tips are one-time consumable purchases, they are generally non-refundable, except as required by applicable law or Apple's refund policies.

6. Intellectual Property

All rights, title, and interest in and to the App, including all software, graphics, designs, and trademarks, are owned by VRealSoftware LLC. You may not copy, modify, distribute, sell, or reverse engineer any portion of the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://inski.app/legal/privacy. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violations of this Agreement or any other reason. Upon termination, you must cease all use of the App and delete it from your devices.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VREALSOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST TWELVE MONTHS.

11. Changes to this Agreement

We may update this Agreement from time to time. We will notify you of material changes by posting the updated Agreement in the App or on our website. Your continued use of the App after changes constitutes acceptance of the updated Agreement.

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Colorado, USA, without regard to its conflict of laws principles. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
