Terms of Service

These Terms of Service ("Terms") govern your access to and use of the InSki mobile applications, websites, and related services (collectively, the “Service”) operated by VRealSoftware LLC (“Company,” “we,” “our,” or “us”), a Colorado limited liability company. By accessing or using InSki, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use InSki. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian consents to these Terms.

2. Description of Service

InSki is a social networking platform for ski enthusiasts where users can follow other users, add friends, discover ski locations, post ski clips, share feed posts and activities, comment on content, list and sell gear, and create or join ski trips with friends. The Service may also offer premium subscription features under the name InSki+.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, complete, and current information, and to keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.

4. Subscription and Payment

InSki+ subscriptions are available on a monthly or yearly basis and are handled through Apple App Store, Google Play, or Stripe (for web). Fees and billing terms are displayed during purchase. Payments are processed by third-party providers, and their respective terms and refund policies apply. Subscriptions automatically renew unless canceled in accordance with the applicable platform’s cancellation procedures.

5. User Content

You may post ski clips, images, comments, and other content (“User Content”). You retain ownership of your User Content but grant VRealSoftware LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content within the Service and for promotional purposes.

You agree not to post explicit, adult, or otherwise unlawful or inappropriate content. InSki reserves the right to remove or moderate content at its sole discretion and to suspend or terminate accounts for violations.

6. Marketplace and Gear Transactions

InSki allows users to list, buy, sell, make offers, or bid on gear items (if the seller enables bidding). All transactions are conducted solely between users. InSki and VRealSoftware LLC do not verify listings, handle payments, guarantee transactions, or resolve disputes. You assume all risks associated with buying or selling gear, including payment, delivery, and condition of items.

Disclaimer: InSki is not a party to any transaction and disclaims all liability for loss, damage, fraud, or disputes arising from user-to-user sales, offers, or bids.

7. Location Data

InSki may collect and process location data to identify when users are near ski areas and display who is “At Location.” The Service does not permanently store precise coordinates but may record general location context for features like ski tracking and location-based interactions. You can manage permissions in your device settings. Continuous location use may occur when ski tracking is active.

8. Code of Conduct

Do not harass, threaten, or impersonate others.
Do not post or share offensive, illegal, explicit, or misleading content.
Do not engage in spam, scams, or fraudulent activity.
Do not interfere with the Service’s operation or security.
Do not use the Service for commercial solicitation without authorization.

VRealSoftware LLC may suspend or terminate accounts that violate these rules or any applicable laws, at our sole discretion.

9. Intellectual Property

All InSki trademarks, logos, and proprietary materials are owned by VRealSoftware LLC or its licensors. You may not copy, modify, or create derivative works from the Service or its content except for content you upload.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your rights to access the Service will cease immediately.

11. Disclaimers

The Service is provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose, reliability, availability, or non-infringement. We do not guarantee that the Service will be error-free, uninterrupted, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, VRealSoftware LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use or inability to use the Service, User Content, or marketplace interactions.

13. Arbitration and Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any dispute or claim arising from or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Denver, Colorado. You and VRealSoftware LLC waive the right to a jury trial or to participate in a class action.

14. International Use

The Service is accessible worldwide but may not be appropriate or available in all jurisdictions. You are responsible for compliance with local laws where you use the Service.

15. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted within the app or on our website and will take effect upon posting. Continued use of the Service constitutes acceptance of the new Terms.
